As many of you know, Local 5098 filed an unfair labor practice charge (ULP) and a grievance against RI Hospital when the attendance policy was instituted at the beginning of this year.
The National Labor Relations Board investigated the charge against the hospital for failing to bargain in good faith over the attendance policy. In March, the NLRB issued a “deferral” letter- meaning they are going to hold off on deciding the issue until the arbitration was decided.
The arbitration has been scheduled for at least three days of hearings: August 23, September 13 and November 2 (if necessary). At the first hearing on August 23, the Union presented its case in chief to the independent arbitrator, providing testimony, documentary evidence and statistical figures regarding the Attendance policy.
The Union will continue its case on September 13, after which the Hospital will present its case to the arbitrator. Once both sides have had an opportunity to present their evidence, the Arbitrator will set a briefing schedule. Once briefs are received by the arbitrator, he will render a written decision, usually 30-60 days after receipt of the briefs.
